TAUNTON COURT RECORDS
Somerset \endash June 16th , 1825
In 1825/1826 John Hake found himself in a spot of trouble, there are two separate entries in the Taunton Court Records:
COURT DESCRIPTION-16TH JUNE 1825 John Hake aged 52, height 6'2'', weight 171, Complexion- Dark, Hair-BrownEyes-Grey, Cut on thumb of left hand, Slight Made(mole), Born Staple Fitzpaine, Trade-Farmer, Last Place of abode-Buckland St Mary, Married 9 Children.
In 1826 he was summoned to appear in Court: The following is a written account of the Hearing.
Shortly before Hilary Term, 1826, a declaration in ejectment on the demise of Edward Hannam and Wadham Wynham, was served upon John Hake, the tenant of a farm at Buckland St Mary, in the County of Somerset. Hake having appeared to this ejectment, signed a cognovits, by the terms of which he agreed to give up possession of all the lands in course for a wheat crop on the 29th September 1826, and the remainder of the premises on the 6th November following. Possession having been demanded and refused, judgement was entered up in the Michaelmas term, and a writ of habere facias possessionem was issued; under which, after considerable difficulty, occasioned by the resistance of Hake and his companions, Hake was removed from the premises. On the 21st June following, Hake with several other persons broke into the house, turned off the cattle, and retook possession of the premises At the following Bridgewater assizes (August 1827) a bill of indictment was preferred and found against Hake and his companions. In this indictment, the first count charged that the defendants on & co with force and arms, and unlawfully and with a strong hand, had entered into certain messuages and lands, to wit & co. situate & co, then being the freehold and in the possession and occupation of said Hannam and Wynham, and had then and there with force and arms, unlawfully with a strong hand, and without judgement recovered, disseised said Hannam and Wynham, expelled and put out said Hannam and Wynham from their possession of the said messuages and lands, and with force and arms from the day and year aforesaid, until the taking of this inquisition, had kept out and still did keep out said Hannam and Wynham so disseised, expelled and put out as aforesaid, against the form & co.The second count charged that Hannam and Wynham had been lawfully possessed of certain other messuages of lands, to wit & co, situate & co, for certain term of years then to come and yet expired, and that Hannam and Wynham being so possessed thereof, defendants on & co, with force and arms, had unlawfully entered & co, and with force and arms had then and there unlawfully expelled and put out the said Hannam and Wymham from the peaceable possession of the last mentioned messauges and lands; and that the defendants with force and arms them the said Hannam and Wynham from & c, until the taking of this inquisition, from the possession of the last mentioned messuages and lands, with force and arms, wrongly and unlawfully then and there had kept out. The Third count charged that the defendants on & c, with force and arms wrongfully, unlawfully, violently, and forcibly had entered into certain other messuages and lands, to wit & c, situate & c, then being in the peaceable possession of the said Hannam and wynham, and that the defendants had then and there with force and arms wrongfully and unlawfully , forcibly, and violently expelled, amoved, and put out the said Hannam and Wynham from the possession of the last mentioned messuages and lands; and the said Hannam and Wynham so expelled, put out, amoved from the possession thereof, as aforesaid, with force and arms wrongfully, forcibly, and violently had kept from & c, and still did keep out. Upon the findings, and upon an affidavit of the facts, Manning moved before Burrough, J. for an order of restitution, upon the authority of the cases collected in Com.Dig, Forceable Entry (D4).The order was made; and the following warrant issued under the seals of the two learned judges:''Somersetshire to wit, sir William Draper Best, Knight, Chief Justice of our lord, the King, of his Court of common pleas, and sir James Burrough, Knight one of the justices of our Lord the King, of his said Court of Common Pleas; justices of our Lord the King, assigned to deliver the goal of the said County of the prisoners therein being and also to hear and determine all felonies, trespasses and other evil doings committed within the same County:To the sheriff of the County of Somerset, greeting. Whereas, by an inquisition taken before us at Bridgewater, in the said County, on this present day of August, in the eighth year of the reign of our said Lord the King, upon the oaths of the Honourable William Waldegrave, William Dickinson, George Edward Allen, John Goodford, Phillip John Miles, William Hanning, Vincent Stuckey, William Helyar, Richard Thomas Combe, Jefferys Allen, Jefferys Thomas Allen, Thomas Shewell Bailward, James Bennett, Robert Phippen, John Barrow, Francis Bryt Morgan, John Hugh Smyth Pigot, Thomas Savage, Reginald Henry Bean, and John Maddison, esqrs: and by virtue of the statutes made and provided, in cases of forcibly entry and detainer, it is found that John Hake, late of the Parish of Buckland St Mary, in the County of Somerset, Yeoman and Mary his wife, John Hake the younger, late of the same place, yeoman, John Pinner, late of the same place, yeoman, John Hooper, late of the same place, Yeoman, on the 21st day of June in the eighth year of the reign of our lord the King, with force and arms, unlawfully and with a strong hand, did enter into certain messuages and lands, to wit, 10 messuages,10 Barns,10 Stables10 Coach Houses200 acres of meadow200 acres of pasture200 acres of other landSituate and lying, and being in the County aforesaid, to wit, in the Parish a foresaid,(following the description of the premises contained in the declaration in ejectment) then being the free hold and in the possession and occupation of Edward Hannam and Wadham Wynham, and then and there unlawfully, and with a strong hand , and without judgement recovered , disseised the said Edward and Wedham, and expelled and put out the said Edward and Wadham from their possession of the said messuages and lands; and with force and arms, unlawfully and with a strong hand, from the day and year aforesaid until the taking of the inquisition, have kept out and still do keep out the said Edward and Wadham, so disseised, expelled, and put out, as aforesaid; against the form of the statute in such case made and provided, and against the peace of our said lord the King, his crown, and dignity.As by the same inquisition more fully appeareth of record. Therefore on behalf of our said lord the King we charge and commend you, that taking with you the power of the County, if it be needful, you go to the said messuages and lands, and that the same you cause to be reseised, and that you caused the said Edward and Wadham to be restored and put into their full possession thereof, according as they before entry aforesaid were seized, according to the form of the said statutes. And this you shall in no wise omit, under the penalty thereon incumbent. Given under our hands and seals, At Bridgewater, in the same County, the 18th August, in the eighth year aforesaid.
